Frequently Asked Questions
Feel free to contact us via e-mail, SMS, phone or contact form on the site. We’ll try to respond as soon as practicable.
If your legal issue involves multiple countries (e.g., cross-border contracts, extradition, family disputes under the Hague Convention), an international lawyer ensures compliance with treaties, local laws, and diplomatic protocols. Even if you have a case in a jurisdiction where we are not licensed we work with network attorneys and can assist in coordination.
With experience in PCI standards and having assisted clients who were the victims of data breaches and computer hacking events, we know that confidentiality laws are not the only thing that needs consideration. We store records using methods where third parties, including governments and competitors that attempt to evade attorney-client privileges, would not be able to access them including, where appropriate, storing the data offline in secure centers that are not known to the public.
As far as privilege, most jurisdictions, including the United States and the United Kingdom, recognize legal privilege as to communications with international counsel so long as the purpose of providing information to us was for legal advice or litigation. Importantly, we would not comply with a disclosure Order unless it met the requirements of both the requesting country and the laws where the records are stored.
One point needs mentioning: Confidentiality is only as good as how you store your own documents. Aggressive governments and corporate espionage services arrange for your computer or telephone to be physically accessed or taken. If you do not have your documents secure, your information could be accessed by others. We help corporations establish privacy-related systems to protect their customers and clients.
We provide full legal services in English and Spanish, with access to translators for other languages as needed. We have had no difficulty communicating with our corporate clients from China, Hong Kong, the Kyrgyz Republic, India, and other countries that are not derivatives of the Latin alphabet.
DR-CAFTA and various international investment treaties ease access to international arbitration and court systems. We specialize in DR-CAFTA takings complaints and have assisted legal teams representing claimants. From arbitration to litigation, ensuring your rights are upheld across member states remains our primary focus.
Extradition varies depending on the jurisdiction and can take multiple years to complete. Many countries use a two step procedure with a court reviewing the alleged crime in the requesting jurisdiction to assure it is also a crime in the country of refuge and that it is not a political crime, then a decision is made on the political level to determine if extradition is appropriate considering various factors. Some jurisdictions allow an appeal from both decisions which some jurisdictions combine them.
We streamline registrations and judicial enforcement through our network attorneys to assist with intellectual property matters including monitoring for infringement in key jurisdictions.
Our fees vary on a case by case basis, whether a flat retainer or an hourly rate. For PCI Compliance Oversight and Data Breach Response services, we ordinarily charge a base fee and an event related fee.
As we work with clients worldwide, many times we meet via video and telephone. We use encrypted document services and highly sensitive materials are removed from the cloud as soon as practicable.
In emergency situations, we can either respond promptly or locate a network attorney who can. For enterprises suffering a data breach, we can provide same day notifications to the appropriate authorities worldwide.
